City of San Rafael Final Investigative Report - Daisy Maraziegos

The City of San Rafael concluded its investigative report into the alleged misconduct by Probationary Officer Daisy Maraziegos on March 29, 2023. The full report can be downloaded HERE . Probationary Officer Maraziegos was the one who initiated contact with the day laborers. She asserts in her reporting that one of the laborers was violating public drunkeness laws, which require that a person be in a state of intoxication such that they cannot care for themselves. Maraziegos asserts her basis for investigating this charge (and starting a chain of events that would send one man to the hospital, bloodied and beaten) because that person had red watery eyes, slurred speech, and was unable to walk steadily. Even the "indepedent" investigator (former police officer Paul Henry) can't get on board with her assessment after reviewing the various body cam footage of her interactions with "Matteo". City of San Rafael Final Investigative Report - Brandon Nail

The city completed its report into Officer Brandon Nail's alleged misconduct on April 5, 2023. The full report is available HERE . Shockingly, the city's investigators found the Nail's violent assault on a member of the San Rafael community was totally fine. Officer Nail was given paid leave for months following the incident before finally being recommended for termination on May 11, 2023 - nearly 10 months after the incident "As set forth above, the Investigator finds that Officer Nail’s use of force was within policy and did not violate the above policies of the San Rafael Police Department and the City of San Rafael during the detention and arrest of Mr. Lopez on July 27, 2022." City Delivers its Report to the Public

After several months of litigation, and the unsuccessful defense by experienced municipal law firm Burke, Williams & Sorensen LLP, the City of San Rafael has complied with a court order to produce documents and reports relating to the use of force incident by its officers on July 29, 2022.
